CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION AND RETURN CONDITIONS

GENERAL:

  1. When you place an order electronically through the website, you are deemed to have accepted the preliminary information form and the distance sales contract presented to you.
  2. Buyers are subject to the provisions of Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188), as well as other applicable laws concerning the sale and delivery of the purchased product.
  3. Shipping charges for product delivery shall be paid by the buyers.
  4. Each purchased product will be delivered to the person and/or organization at the address indicated by the buyer within a maximum legal period of 30 days. If the product is not delivered within this period, buyers may terminate the contract.
  5. The purchased product must be delivered complete, in accordance with the specifications indicated in the order, and accompanied by any applicable documents such as warranty certificates or user manuals.
  6. If it becomes impossible to sell the purchased product, the seller must notify the buyer in writing within 3 days of becoming aware of this. The total amount must be refunded to the buyer within 14 days.

 

IF THE PURCHASE PRICE IS NOT PAID:

  1. If the buyer does not pay the purchase price or cancels it in the banking records, the seller’s obligation to deliver the product ends.

 

TRANSACTIONS WITH UNAUTHORIZED CREDIT CARD USE:

  1. If, after delivery, it is determined that the buyer’s credit card was wrongfully used by unauthorized parties and the selling bank or financial institution does not pay the seller, the buyer must return the product to the seller within 3 days at the seller’s expense for shipping.

 

IF UNFORESEEN CIRCUMSTANCES PREVENT ON‑TIME DELIVERY:

  1. If the seller encounters unforeseeable force majeure events and cannot deliver the product on time, the buyer will be notified. The buyer may request cancellation of the order, replacement with a similar product, or postponement of delivery until the obstacle is removed. If the buyer cancels and paid in cash, the amount will be refunded in cash within 14 days of cancellation. If the buyer paid by credit card and cancels, the amount will be refunded to the bank within 14 days, although the bank may take 2–3 weeks to transfer it to the buyer’s account.

 

BUYER’S OBLIGATION TO INSPECT:

  1. Before accepting delivery, the buyer shall inspect the goods/services; any damaged or defective items (dents, breaks, torn packaging, etc.) must not be accepted from the carrier. Delivered goods/services are deemed undamaged. After delivery, the buyer must handle them with care. If exercising the right of withdrawal, the goods/services must not be used. The invoice must also be returned with the product.

 

RIGHT OF WITHDRAWAL:

  1. The buyer may exercise the right of withdrawal, without any legal or penal liability and without stating a reason, by notifying the seller within 14 (fourteen) days from the delivery date to the buyer or the person/organization at the specified address via the contact information below.

DURATION OF THE RIGHT OF WITHDRAWAL:

  1. If the purchase is a service, the 14‑day period begins from the date the contract is signed. For service contracts where performance has begun with the consumer’s consent before the end of the period, the right of withdrawal cannot be exercised.
  2. Costs arising from the exercise of the right of withdrawal are borne by the seller.
  3. To exercise the right of withdrawal, the buyer must notify the seller in writing by registered mail, fax, or email within 14 (fourteen) days, and the product must be unused in accordance with the “Products for Which the Right of Withdrawal Cannot Be Used” provisions.

 

EXERCISE OF THE RIGHT OF WITHDRAWAL:

  1. The invoice for the product delivered to a third party or the buyer (if the invoice is issued to a corporate entity, it must be returned together with the return invoice issued by that entity; corporate returns cannot be completed without issuing a RETURN INVOICE).
  2. The return form, the box and packaging of the products to be returned, and any standard accessories must be delivered complete and undamaged.

 

RETURN CONDITIONS:

  1. The seller must refund the total price and return any binding documents to the buyer within 10 days of receiving the withdrawal notice, and must collect the goods within 20 days.
  2. If the value of the goods decreases due to the buyer’s fault or if the return becomes impossible, the buyer must compensate the seller for damages proportional to the fault. However, the buyer is not responsible for changes or deterioration resulting from proper use during the withdrawal period.
  3. If exercising the right of withdrawal reduces the campaign’s total limit below the campaign threshold, the discount enjoyed under the campaign will be cancelled.

 

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE USED:

  1. Custom-made products prepared at the buyer’s request or according to personal needs and not suitable for return; lower underwear; swimwear bottoms; makeup products; disposable items; perishable goods or items with an expiration date; items whose packaging the buyer has opened and which are not hygienically returnable; items that mix with others upon delivery and cannot be separated; periodicals (newspapers, magazines) outside subscription contracts; digital services or intangible goods delivered immediately; audio or video recordings; books; software; data recording/storage devices; computer consumables—all of which cannot be returned once opened, as per the Regulation. Additionally, the right of withdrawal cannot be exercised for services whose performance has begun with the consumer’s consent before the end of the withdrawal period.
  2. To return cosmetic and personal care products; underwear; swimwear; books; copyable software; DVDs, VCDs, CDs, cassettes; and stationery supplies (toner, cartridges, ribbons, etc.), their packaging must be unopened, untested, intact, and unused.

 

DEFAULT AND LEGAL CONSEQUENCES:

  1. If the buyer defaults on a credit card payment, the buyer agrees to pay interest under the credit card agreement with the issuing bank and to be liable to the bank. The bank may take legal action, demand any costs and attorney’s fees from the buyer, and the buyer agrees to compensate the seller for any loss or damage arising from delayed fulfillment of the debt.
