1. Parties

This Distance Selling Contract (“Contract”) is entered into between:

Buyer: The individual or legal entity placing an order through the website.

By placing an order, the Buyer accepts this Contract electronically.

2. Scope

This Contract governs the sale and delivery of physical goods sold online, including but not limited to:

  • Food supplements
  • Clothing
  • Personal care products
  • Intimate products
  • Accessories

All products are shipped internationally from Türkiye.

3. Eligibility

The Buyer must be at least 18 years of age to place an order. By completing a purchase, the Buyer confirms that they meet this requirement.

4. Prices and Payment

All prices are listed in EUR unless otherwise specified.

Payments are processed securely via:

  • Credit/Debit Card (Stripe)
  • Apple Pay
  • Google Pay

The Seller does not store full payment card details.

5. Delivery

Estimated delivery times:

  • European Union: 5–12 business days
  • Worldwide: 7–21 business days

Delivery times are estimates and may vary due to customs procedures or international logistics conditions.

The Buyer is responsible for providing accurate shipping information.

6. Customs and Import Duties

International shipments may be subject to customs duties, VAT, or import taxes imposed by the destination country. Such charges are the responsibility of the Buyer.

7. Right of Withdrawal (EU Consumers)

If the Buyer resides in the European Union, they have the right to withdraw from the purchase within fourteen (14) days of receiving the goods, in accordance with Directive 2011/83/EU.

The withdrawal request must be submitted within the 14-day period via email, WhatsApp, or contact form.

8. Exemptions from Withdrawal

The right of withdrawal does not apply to:

  • Sealed goods unsealed after delivery which are not suitable for return due to health protection or hygiene reasons
  • Food supplements and consumable goods
  • Intimate or personal care products once opened
  • Underwear and inner garments
  • Used or altered items

9. Returns and Refunds

Return requests must be submitted within 14 days of delivery.

Approved refunds are processed via Stripe to the original payment method after inspection of the returned product.

No restocking fee applies.

10. Damaged or Incorrect Products

The Buyer must report damaged or incorrect goods within 48 hours of delivery and provide supporting evidence.

11. Refused or Undeliverable Shipments

If a shipment is refused or returned due to failure to pay customs charges or incorrect address information, associated costs may be deducted from the refundable amount.

12. Limitation of Liability

To the maximum extent permitted by applicable law, AMERKEZ LLC shall not be liable for indirect, incidental, or consequential damages arising from the use or misuse of the products.

13. Governing Law and Jurisdiction

This Contract shall be governed by the laws of the State of New Mexico, United States.

Any disputes arising from this Contract shall be subject to the exclusive jurisdiction of the courts located in New Mexico.

14. Acceptance

By completing an online order, the Buyer confirms that they have read, understood, and accepted this Distance Selling Contract.
